Please read these Terms and Conditions (“Terms”) carefully before using herdaytoo.com (the “Site”) or placing any order. By accessing the Site, submitting photos, selecting music, or purchasing any product or service, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Her Day Too™

Her Day Too™ is a personalized keepsake and digital media service. We create custom tribute videos using your submitted photographs and a licensed music track, which are hosted online and accessible via a unique QR code printed on or delivered with your branded physical product (acrylic photo block or other merchandise).

2. Eligibility & Account

You must be at least 18 years of age to place an order. By submitting an order, you confirm that all information provided is accurate, that you have authority to agree to these Terms, and that you have the rights to all photographs submitted.

3. Photo Submission – Your Responsibilities

3.1 Ownership & Rights

By uploading photographs to our platform, you represent and warrant that:

• You own the photographs outright, or hold all necessary permissions from the copyright holder and any individuals depicted.

• The photographs do not infringe any third-party intellectual property, privacy, or publicity rights.

• You have obtained consent from any identifiable individuals depicted in the images, particularly children.

• The photographs do not contain unlawful, obscene, defamatory, or offensive content.

Her Day Too™ accepts no liability for any claim arising from photos you submit. You agree to indemnify and hold harmless Her Day Too™ from any loss, damage, or legal cost arising from a breach of the above.

3.2 Photo Quality & Suitability

We will make reasonable efforts to produce a high-quality tribute video from the photos you provide. However, we cannot guarantee results where:

• Images are low resolution, blurry, heavily compressed, or poorly lit.

• Photos contain watermarks, text overlays, or conflicting graphics.

• The number of photos submitted falls significantly below our recommended minimum.

If submitted photos are unsuitable, we will contact you to request replacements. This may affect production timelines.

3.3 Data Handling & Privacy

Your photos are stored securely and used solely for the purpose of fulfilling your order. We do not sell, share, or use your images for marketing without your explicit written consent. Photos may be stored for up to 12 months after order fulfillment to allow for re-ordering or corrections, after which they are permanently deleted. Please refer to our separate Privacy Policy for full details.

4. Music Licensing & Song Selection

4.1 Licensed Music

Her Day Too™ offers a curated selection of licensed music tracks for use within your tribute video. All tracks available on our platform are licensed for synchronization within our service. You may not request tracks outside of the available catalogue unless otherwise agreed in writing.

4.2 Original Artist Music

Her Day Too™ features original songs including its signature track. These songs are owned by or exclusively licensed to Her Day Too™. They are licensed to you for personal, non-commercial use within your tribute video only. You may not download, reproduce, distribute, perform publicly, or use these recordings outside of the tribute video delivered to you.

4.3 Third-Party Music Restrictions

We are unable to incorporate music that you supply externally (e.g. from Spotify, Apple Music, or personal recordings) unless we have verified that a synchronization license exists for that track. Requests to use third-party music not in our catalogue will be declined to protect all parties from copyright infringement liability.

4.4 Streaming Platform Restrictions

Tribute videos hosted on our platform are for private viewing via QR code only. They are not authorized for upload to YouTube, TikTok, Instagram, Facebook, or any other public streaming or social media platform, as doing so may constitute copyright infringement and could result in content takedown or legal action by rights holders. Her Day Too™ accepts no liability for such actions.

5. Tribute Video Production

5.1 Production Process

Once your order is placed and your photos have been received and approved, we will produce your custom tribute video. Production typically takes 5–7 business days, though timelines may vary during high-demand periods. We will communicate any delays.

5.2 Revisions

Each order includes one (1) complimentary revision request, which must be submitted within 7 days of your video being delivered. Revision requests are limited to changes to photo ordering, transitions, or timing. Requests to change the selected music track after production has commenced may incur an additional fee.

5.3 Approval & Final Delivery

You will receive a preview link to review your tribute video before your physical product is dispatched. By approving the video (or by not raising a revision request within 7 days of delivery), you confirm satisfaction with the digital content. Her Day Too™ is not responsible for errors identified after this approval window has closed.

6. QR Code & Digital Access

6.1 Hosted Video Access

Your tribute video is hosted on our secure platform and accessed via a unique QR code. Her Day Too™ guarantees video hosting access for a minimum period of three (3) years from the date of purchase. We will make reasonable efforts to maintain access beyond this period.

6.2 Service Continuity

While we take every measure to ensure continuous availability, Her Day Too™ cannot guarantee uninterrupted access due to factors including but not limited to: scheduled maintenance, third-party hosting outages, or unforeseen technical failures. We will endeavor to provide advance notice of planned downtime.

6.3 QR Code Care

The QR code printed on your physical product must be kept in a readable condition. Her Day Too™ is not responsible for access failure due to damage, wear, scratches, or obstruction of the QR code. Replacement QR codes or updated access links can be provided upon request for a small administrative fee.

6.4 URL & Link Integrity

In the event that our hosting provider changes or our domain changes, we will redirect existing QR code links to the new location for a minimum of 12 months and will notify customers via email where possible.

7. Physical Products – Branded Merchandise

7.1 Product Descriptions

We take care to ensure that product descriptions, images, and specifications on our Site are accurate. However, colors and finishes may appear differently on-screen compared to the physical product due to monitor calibration and printing variances. Minor variations are not considered defects.

7.2 Production & Shipping

Branded physical products (including acrylic photo blocks) are produced on demand by our fulfillment partner. Production and shipping timelines are estimates and may vary. Her Day Too™ is not responsible for delays caused by third-party fulfillment or courier services once goods have been dispatched.

7.3 Damaged or Defective Items

If your physical product arrives damaged or defective, please contact us at hello@herdaytoo.com within 14 days of receipt with photographic evidence. We will arrange a replacement at no additional cost. We are unable to process claims raised outside of this window.

7.4 Returns & Refunds – Personalized Products

As all physical products are personalized and made to order, they are exempt from standard right-of-return rules under applicable consumer protection legislation. We do not accept returns or offer refunds on personalized items unless the product is faulty or does not match its confirmed specification.

7.5 Digital Products

Once a tribute video has been produced and the preview link has been delivered to you, the digital component of your order is considered fulfilled. Refunds on the digital service element are not available after this point. If you experience a technical issue accessing your video, please contact us and we will resolve it promptly.

8. Payment & Pricing

All prices displayed on the Site are in USD unless otherwise stated and are inclusive of applicable taxes where required by law. Payment is processed securely through our payment provider. Her Day Too™ does not store your payment card information. Full payment is required at the time of order placement.

We reserve the right to correct pricing errors. In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order for a full refund.

9. Intellectual Property

All content on the Her Day Too™ website, including but not limited to the brand name, logo, original songs, design elements, and video templates, is the property of Her Day Too™ and is protected by copyright and trademark law. You are granted a limited, non-exclusive, non-transferable license to access and use the Site and your personalized deliverables for personal, non-commercial purposes only.

You may not reproduce, distribute, publicly display, or create derivative works from any Her Day Too™ content without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, Her Day Too™ and its officers, employees, and partners shall not be liable for:

• Any indirect, incidental, consequential, or special damages arising from your use of our services.

• Loss of data, including loss of submitted photographs due to circumstances beyond our reasonable control.

• Dissatisfaction with the creative output of a tribute video where photos and instructions provided were of acceptable quality.

• Third-party copyright claims arising from photos or music requests you supplied.

• Delays or failures caused by third-party fulfillment, courier, or hosting providers.

Our total liability to you for any claim arising from an order shall not exceed the amount paid by you for that order.

11. Indemnification

You agree to indemnify, defend, and hold harmless Her Day Too™, its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any third-party rights, including copyright or privacy rights, in connection with content you submit; or (c) your use of the Site or services in any manner not authorized by these Terms.

12. User Conduct

You agree not to use the Site or services to:

• Submit content that is unlawful, defamatory, obscene, harassing, or threatening.

• Infringe the intellectual property or privacy rights of any third party.

• Attempt to gain unauthorized access to any part of the Site or our systems.

• Use automated tools to scrape, copy, or harvest content from the Site.

13. Modifications to Terms

Her Day Too™ reserves the right to update or modify these Terms at any time. We will post the revised Terms on the Site with an updated effective date. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States. Any dispute arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Dallas County, State of Texas..

We encourage you to contact us in the first instance to resolve any concern informally before pursuing formal legal action. Most issues can be resolved quickly and amicably.
